The Thai Criminal Court issued arrest warrants today for 9 leaders of the People’s Alliance for Democracy ‘PAD’ for their involvement in the PAD raid on Thailand’s NBT TV station in Bangkok and the Government House in Bangkok. The Court made the decision on the request of Thai police based on video evidence of the 2 Bangkok incidents.

National police chief Police General Patcharawat Wongsuwan said PAD leaders would be informed immediately of the Thai Court’s order. The warrants are serious charges that could lead to life imprisonment if offenders are convicted.

The arrest warrants were issued for 9 PAD leaders; Amorn Amornwattananon, Chamlong Srimuang, Pibhop Dhongchai, Sondhi Limthongkul, Somsak Kosaisuk, Somkiat Pongpaiboon, Suriyasai Katasila, and Therdpoom Jaidee.

They could be tried for following offenses in Thailand;

Under Thailand’s Article 113, it is deemed an offense for any individual to assault or threaten to assault in order to overthrow the administrative power sanctioned by the Constitution. Offenders are deemed to have committed treason punishable by death or life imprisonment.

Under Thailand’s Article 114, it is deemed an offense for any individual to mobilize manpower and weapons, or to make other preparations, or to conspire in order to commit treason, or commit any wrongdoing which is part of the plans, or to incite the people to commit treason, or to be an accessory to treason. Offenders face a jail sentence of three to five years.

Under Thailand’s Article 215, it is deemed an offense for the involvement of any individual in criminal association with more than 10 people in order to assault or threaten to assault or commit any action leading to disturbances in society. Offenders face a jail term of up to six months and/or a fine of up to 2,000 baht.

If the offender was armed, the penalties are a jail term of up to two years and/or a fine of up to Bt4,000. If the offender was the lead culprit or acted as the mastermind, the penalties are a jail term of up to five years and/or a fine of up to 10,000 baht.

Under Thailand’s Article 216, it is deemed an offense for any individual to resist the order given by law enforcement authorities to quit a criminal association under Article 215. Offenders face a jail term of up to three years and/or a fine of up to 6,000 baht.

The PAD claims the right to protest under Thai Article 63 of the constitution, the PAD’s campaign was seen as an instigation of civil unrest and was therefore a threat to national security sources said.
